BREACH OF CONTRACT ON THE PART OF THE CUSTOMER. 12.1 What is deemed to constitute breach of contract There is breach of contract on the part of the Customer if the Customer fails to perform its duties under the Agreement, and this is not caused by circumstances related to the Contractor or by force majeure.
