Common use of Breach of Contract or Negligence Clause in Contracts

Breach of Contract or Negligence. If CPC causes any loss to the Customer due to: (a) any breach of this Agreement including a fundamental breach; or (b) any tortious conduct, CPC’s liability (if any) for such loss will be limited to a maximum of the aggregate of all amounts paid by the Customer to CPC under this Agreement during the 12 months immediately preceding the breach or tortious conduct (as the case may be).
