Breach of Licence Terms. Without limiting clause 12.3, any use of the Windcave Solution, the Goods, the Software, or the Documentation by Customer for any purpose other than the Permitted Use, or any breach by Customer of the provisions of clause 16 will be deemed to be a material breach of this Agreement which for the purposes of clause 12.3 Customer has failed to remedy.
