Common use of Breach of Material Representation or Warranty Clause in Contracts

Breach of Material Representation or Warranty. Any material representation or warranty of the Issuer or the Tenant contained herein, in the Site Lease, the Project Lease or in any certificate or other instrument or document delivered hereunder or thereunder or in connection with the financing of the Project shall prove to have been false or incorrect or breached in any material respect on the date on which it is made;
