OptiMark shall fail to perform, keep or observe any provision (other than a breach of the preceding Sections 7.1.1 or 7.1.8) not involving a payment obligation of this Loan Agreement, contained in this Loan Agreement and any such failure shall remain unremedied for thirty (30) days after written notification thereof shall have been given to OptiMark by Softbank; or
