Common use of Breach of other obligations Clause in Contracts

Breach of other obligations. (a) An Obligor does not comply with any term of Clause 19.7 (Disposals) or Clause 19.9 (Mergers); or (b) an Obligor does not comply with any other term of the Finance Documents not already referred to in this Clause, unless the non- compliance: (i) is capable of remedy; and (ii) is remedied within 21 days of the earlier of the Facility Agent giving notice and the Obligor becoming aware of the non- compliance.

Breach of other obligations. (a) An Obligor does not comply with any term of Clause 19.7 18 (Disposals) or Clause 19.9 (MergersFinancial covenants); or (b) an Obligor does not comply with any other term of the Finance Documents not already (other than any term referred to in this ClauseClause 20.2 (Non-payment) or in paragraph (a) above), unless the non- non-compliance: (i) is capable of remedy; and (ii) is remedied within 21 days of the earlier of the Facility Agent giving notice of the breach to KDG and the any Obligor becoming aware of the non- non-compliance.

(a) An Obligor does not comply with any term of Clause 19.7 19 (Disposals) or Clause 19.9 (MergersFinancial covenants); or (b) an Obligor does not comply with any other term of the Finance Documents not already (other than any term referred to in this ClauseSubclause 21.2 (Non-payment) or in paragraph (a) above), unless the non- non-compliance: (i) is capable of remedy; and (ii) is remedied within 21 30 days of the earlier of the Facility Agent giving notice of the failure to comply to the Company and the any Obligor becoming aware of the non- non-compliance.

(a) An Obligor does not comply with any term of Clause 19.7 21 (Disposals) or Clause 19.9 (MergersFinancial covenants); or (b) an Obligor does not comply with any other term of the Finance Documents not already (other than any term referred to in this ClauseSubclause 23.2 (Non-payment) or in paragraph (a) above), unless the non- non-compliance: (i) is capable of remedy; and (ii) is remedied within 21 10 days of the earlier of the Facility Agent giving notice of the failure to comply to the Company and the any Obligor becoming aware of the non- non-compliance.

(a) An Obligor does not comply with any term of Clause 19.7 18 (Disposals) or Clause 19.9 (MergersFinancial Covenants); or (b) an An Obligor does not comply with any other term of the Finance Documents not already (other than any term referred to in this ClauseClause 20.2 (Non-payment) or in paragraph (a) above), unless the non- non-compliance: (i) is capable of remedy; and (ii) is remedied within 21 days 15 Business Days of the earlier of the Facility Agent giving notice of the failure to comply to the Company and the any Obligor becoming aware of the non- non-compliance.

(a) An Obligor The Parent does not comply with any term of Clause 19.7 22 (Disposals) or Clause 19.9 (MergersFinancial covenants); or (b) an Obligor does not comply with any other term of the Finance Documents not already referred to in this Clause, unless the non- non-compliance: (i) is capable of remedy; and (ii) is remedied within 21 days twenty Business Days of the earlier of the Facility Agent giving notice and the Obligor becoming aware of the non- non-compliance.

(a) An A Relevant Obligor does not comply with any term of Clause 19.7 18 (Disposals) or Clause 19.9 (MergersFinancial covenants); or (b) an Obligor does not comply with any other term of the Finance Documents not already (other than any term referred to in this ClauseClause 20.2 (Non-payment) or in paragraph (a) above), unless the non- non-compliance: (i) is capable of remedy; and (ii) is remedied within 21 14 days of the earlier of the Facility Agent giving notice of the breach to any Obligor and the any Obligor becoming aware of the non- non-compliance.

(a) An Obligor does not comply with any term of Clause 19.7 clause 18 (Disposals) or Clause 19.9 (MergersFinancial covenants); or (b) an Obligor does not comply with any other term of the Finance Documents not already referred to in this Clause, unless the non- non-compliance: (i) is capable of remedy; and (ii) is remedied within 21 fourteen days of the earlier of the Facility Agent giving notice and the Obligor becoming aware of the non- non-compliance.

(a) An Obligor does not comply with any term of Clause 19.7 16 (DisposalsGeneral covenants) or Clause 19.9 clause 7 (Mergers)General covenants) of the Guarantee; or (b) an Obligor does not comply with any other term of the Finance Documents not already referred to in this Clause, unless the non- non-compliance: (i) is capable of remedy; and (ii) is remedied within 21 14 days of the earlier of the Facility Administrative Agent giving notice of the breach to the Company and the any Obligor becoming aware of the non- non-compliance.
