Breach of Remedial Action Plan. (a) In the event that AHS determines that the Service Provider is in breach of any term or condition of the Remedial Action Plan or fails to implement such plan, such breach or failure to implement shall be deemed to be a breach under this Agreement and the Parties shall follow the default provisions in accordance with Article 3 of this Agreement.
