Common use of Breach of Representation or Warranty Clause in Contracts

Breach of Representation or Warranty. Any representation, warranty or certification made or deemed made by the Borrower to the Administrative Agent or any Lender herein or by the Borrower or any of its Restricted Subsidiaries in or in connection with this Agreement or any of the other Loan Documents or any amendment or modification thereof or waiver thereunder, or in any statement, report, certificate, financial statement or other document at any time given by any such Person pursuant to any of the Loan Documents shall be false or misleading in any material respect on the date as of which made (or deemed made).

Breach of Representation or Warranty. Any representation, representation or warranty or certification made or deemed made by the Company or any Subsidiary Borrower to the Administrative Agent or any Lender herein or by the Company or any Subsidiary Borrower or any of its Restricted their Subsidiaries in or in connection with this Agreement or any of the other Loan Documents or any amendment or modification thereof or waiver thereunder, or in any statement, report, certificate, financial written statement or other document certificate or written information at any time given by any such Person pursuant to any of the Loan Documents shall be false or misleading in any material respect on the date as of which made (or deemed made).

Any representation, representation or warranty or certification made or deemed made by the Borrower or any of the parties to the Guaranties to the Administrative Agent Agent, the Arranger or any Lender herein or by the Borrower or any of its Restricted the parties to the Guaranties or any of their Subsidiaries in or in connection with this Agreement or any of the other Loan Documents or any amendment or modification thereof or waiver thereunder, or in any statement, report, certificate, financial statement or other document certificate at any time given by any such Person pursuant to any of the Loan Documents shall be false or misleading in any material respect on the date as of which made (or deemed made)made or given.

Breach of Representation or Warranty. Any representation, representation or warranty or certification made or deemed made by the Borrower to the Administrative Agent or any Lender herein or by of the Borrower or any of its Restricted Subsidiaries made or deemed to be made hereunder or in any other Loan Document executed by it or any other writing or certificate furnished by or on behalf of the Borrower or any of its Restricted Subsidiaries to the Administrative Agent, or any other Lender Party for the purposes of or in connection with this Agreement or any of the other Loan Documents or Document (including any amendment or modification thereof or waiver thereunder, or in any statement, report, certificate, financial statement or other document at any time given by any such Person certificates delivered pursuant to any of the Loan Documents Article V) is or shall be false or misleading incorrect in any material respect on the date as of which when made (or deemed made).
