Common use of Breach of Subcontract Clause in Contracts

Breach of Subcontract. Any failure of the Subcontractor to fulfill its obligations under the Subcontract shall constitute a breach of the Subcontract. Breach shall include, but is not limited to, the following: (1) the Subcontractor fails to prosecute the Work diligently, in accordance with established schedules, or to make such progress in the Work as the Contractor reasonably believes is necessary to complete the Work within the time required by this Subcontract; (2) the Subcontractor fails to perform the Work in a good and workmanlike manner, to maintain adequate quality control of its Work, or to correct defects in the Work promptly upon notice by the Contractor; (3) the Contractor reasonably determines that the Subcontractor has abandoned the Work,
