BREACH OF THIS LEASE BY THE LANDLORD. 38.1 If the Landlord commits a Material Breach of this Lease, the Tenant may apply to a Court: 38.1.1 for the recovery of any damage suffered by the Tenant as a result of such Material Breach; and 38.1.2 for specific performance by the Landlord of any obligation under this Lease. 38.2 The Tenant may also cancel this Lease, without penalty, if the Landlord does not remedy the Material Breach within 20 (Twenty) Business Days of notification being sent to the Landlord instructing the Landlord to do so.
