Common use of Bribes and Kickbacks Clause in Contracts

Bribes and Kickbacks. The DB shall not by any means: 3.6.1 induce any person or entity employed in the construction of the Project to give up any part of the compensation to which that person or entity is entitled; 3.6.2 confer on any governmental, public or quasi-public official having any authority or influence over the Project, any payment, loan, subscription, advance, deposit of money, services or anything of value, present or promised; 3.6.3 offer nor accept any bribes or kick-backs in connection with the Project from or to any individual or entity, including any of its trade contractors, subcontractors, consultants, suppliers or manufacturers of Project goods and materials; or 3.6.4 without the express written permission of the Owner, call for or by exclusion require or recommend the use of any subcontractor, consultant, product, material, equipment, system, process or procedure in which the DB has a direct or indirect proprietary or other pecuniary interest.
