Common use of BUYER'S MODIFICATIONS Clause in Contracts

BUYER'S MODIFICATIONS. All changes to Specifications, including, but not limited to, new product SKU introductions (collectively "Modifications"), require the prior written consent of Supplier, such consent not to be unreasonably withheld. Buyer will utilize the Cost and Feasibility Process set forth below in Section 6.04 in order to seek the necessary prior written consent of Supplier. Buyer will be responsible for any costs and expenses associated with such Modifications, including, but not limited to any testing required for such Modifications and any costs and expenses thereof.
