Common use of By Engineer Clause in Contracts

By Engineer. Engineer may, after giving seven days written notice to Owner, suspend services under this Agreement if Owner has failed to pay Engineer for invoiced services and expenses, as set forth in Paragraph 4.02.B, or in response to the presence of Constituents of Concern at the Site, as set forth in Paragraph 6.10.D.

By Engineer. Engineer may, after giving seven days 7 days’ written notice to Owner, suspend services under this Agreement Agreement: a. if Owner has failed to pay Engineer for invoiced services and expenses, as set forth in Paragraph 4.02.B, or in response to Paragraphs 4.02.B and 4.02.C; b. if persistent circumstances beyond the presence control of Constituents of Concern at the Site, as set forth in Paragraph 6.10.D.Engineer have prevented it from performing its obligations under this Agreement.

Engineer may, after giving seven days written notice to Owner, suspend services under this Agreement if Owner has failed to pay Engineer for invoiced services and expenses, as set forth in Paragraph 4.02.B5.02.B, or in response to the presence of Constituents of Concern at the Site, as set forth in Paragraph 6.10.D.7.10.D.

By Engineer. Engineer may, after giving seven days written notice to Owner, suspend services under this Agreement if Owner has failed to pay Engineer for invoiced services and expenses, as set forth in Paragraph 4.02.B4.01, or in response to the presence of Constituents of Concern at the Site, as set forth in Paragraph 6.10.D.6.10.

By Engineer. Engineer may, after giving seven days written notice to Owner, suspend services under this Agreement if Owner has failed to pay Engineer for invoiced services and expenses, as set forth in Paragraph 4.02.B, or in response to the presence of Agreement No A24-3257-7 Constituents of Concern at the Site, as set forth in Paragraph 6.10.D.

Engineer may, after giving seven days written notice to Owner, suspend services under this Agreement if Owner has failed to pay Engineer for invoiced services and expenses, as set forth in Paragraph 4.02.B, or in response to the presence of Constituents of Concern at the Site, as set forth in Paragraph 6.10.D.

Engineer may, after giving seven days 7 days’ written notice to Owner, suspend services under this Agreement Agreement: a. if Owner has failed to pay Engineer for invoiced services and expenses, as set forth in Paragraph 4.02.B, or Paragraphs 4.02.B and 4.02.C; b. in response to the presence of Constituents of Concern at the Site, as set forth in Paragraph 6.10.D.6.09.D; or c. if persistent circumstances beyond the control of Engineer have prevented it from performing its obligations under this Agreement.
