Common use of By Flextronics Clause in Contracts

By Flextronics. With respect to matters not covered in Section 14.1, Flextronics shall indemnify and hold Nortel Networks, its customers, distributors and their employees, harmless from any losses, damages, liabilities and costs including reasonable attorney’s fees arising from any injury or death to persons or loss of or damage to property to the extent caused by any method or process used in the performance of Repair Services, and, any defect or deficiency including any defect or deficiency in any parts or components used in the Repair process, or Flextronics’ negligence or willful misconduct.

By Flextronics. With respect to matters not covered in Section 14.115.1, Flextronics shall indemnify and hold Nortel Networks, its customers, distributors and their employees, harmless from any losses, damages, liabilities and costs including reasonable attorney’s fees arising from any injury or death to persons or loss of or damage to property to the extent caused by any manufacturing method or process used in relating to the performance of Repair Services, andProducts, any defect manufacturing defects or deficiency including any defect or deficiency in any parts or components supplied by SC Suppliers used in the Repair processProducts or the manufacturing process related thereto, or Flextronics’ ’s negligence or willful wilful misconduct.

With respect to matters not covered in Section 14.113.1, Flextronics shall indemnify and hold Nortel Networks, its customersCustomers, distributors and their employees, harmless from any losses, damages, liabilities and costs including reasonable attorney’s fees arising from any injury or death to persons or loss of or damage to property to the extent caused by any method or process used in relating to the performance of Repair Services, and, any defect or deficiency including any defect or deficiency errors and omissions made by Flextronics in any parts or components used in connection with the Repair processdelivery of the Services, or Flextronics’ negligence or willful misconduct.

With respect to matters not covered in Section 14.113.1, Flextronics shall indemnify and hold Nortel Networks, its customersCustomers, distributors and their employees, harmless from any losses, damages, liabilities and costs including reasonable attorney’s fees arising from any injury or death to persons or loss of or damage to property to the extent caused by any ( 35 ) method or process used in relating to the performance of Repair Services, and, any defect or deficiency including any defect or deficiency errors and omissions made by Flextronics in any parts or components used in connection with the Repair processdelivery of the Services, or Flextronics’ negligence or willful misconduct.
