Common use of By Tenable Clause in Contracts

By Tenable. Tenable shall (at its sole cost and expense): (i) defend and/or settle on behalf of Customer (including Customer’s officers, directors, employees, representatives and agents); and (ii) indemnify Customer for, any third party claims brought against Customer based upon a claim that Customer’s use of the Products in accordance with this Agreement infringes or misappropriates such third party’s intellectual property rights in a jurisdiction which is signatory to the Berne Convention.

By Tenable. Tenable shall (at its sole cost and expense): (i) defend and/or settle on behalf of Customer (including Customer’s CustomerÕs officers, directors, employees, representatives and agents); and (ii) indemnify Customer for, any third party claims brought against Customer based upon a claim that Customer’s CustomerÕs use of the Products in accordance with this Agreement infringes or misappropriates such third party’s partyÕs intellectual property rights in a jurisdiction which is signatory to the Berne Convention.
