Common use of By the MCO Clause in Contracts

By the MCO. This Contract may be terminated by the MCO, in the event of the STATE’s material breach of this Contract, upon a one hundred and fifty (150) calendar day advance written notice to the STATE. In the event of such termination, the MCO shall be entitled to payment, determined on a pro rata basis, for work or services satisfactorily performed through the effective date of cancellation or termination.
