Cabling Crossings. The County acknowledges that Turtle Creek may desire to route certain wires, cables, conduits and/or lines (and their associated equipment) related to the transmission of electricity (i) at a voltage of up to 34.5 kV from the Project below ground at a location adjacent to or under (including across) certain County Designated Roads, as identified on Appendix D (the “34.5 kV Installation”) (ii) at a voltage of up to 345 kV from the Project above ground at a location adjacent to or over (including across) certain County Designated Roads, as identified on Appendix D (the “345 kV Installation”). In connection with both the 34.5 kV Installation and the 345 kV Installation, the Parties further agree that Turtle Creek shall be responsible for obtaining all private land rights as are necessary to permit Turtle Creek to complete the 34.5 kV Installation and the 345 kV Installation and make the modifications and improvements to the Designated Roads contemplated by this Agreement, including obtaining all necessary land rights from private landowners adjacent to the Designated Roads. In connection with the 34.5kV Installation and the 345 kV Installation, the County hereby grants to Turtle Creek all such authorizations and approvals from the County as are necessary to complete the 34.5kV Installation and the 345 kV Installation subject only to Turtle Creek’s obtaining all private land rights as are required in connection therewith; provided that any trenching of a Designated Road in connection with the 34.5 kV Installation shall require the prior written consent of the County.
