Common use of Cancellation by Allottee-(s) Clause in Contracts

Cancellation by Allottee-(s). The Allottee(s) shall have the right to cancel/ withdraw his/her/its allotment in the Project as provided in the Act:. Provided that where the Allottee(s) proposes to cancel/withdraw from the Project without any fault of the Promoter, the Promoter herein is entitled to forfeit the booking amount paid for the allotment. The balance amount of money paid by the Allottee(s) shall be returned by the Promoter to the Allottee(s) within forty-five days of such cancellation.

Cancellation by Allottee-(s). The Allottee(s) Allottee/s shall have the right to cancel/ cancel/withdraw his/her/its his allotment in the Project as provided in the Act:. Provided that where the Allottee(s) Allottee/s proposes to cancel/withdraw from the Project without any fault of the PromoterDeveloper, the Promoter Developer herein is entitled to forfeit the booking amount paid for the allotment. The balance amount of money paid by the Allottee(s) Allottee/s shall be returned by the Promoter Developer to the Allottee(sAllottee/s within 45 (forty five) within forty-five days of such cancellation.

The balance amount of money paid by due and payable to the Allottee(s) shall be returned Allottees without interest within 45 days from the date of acceptance of the notice by the Promoter which was sent by Allottees requesting to cancel the Allottee(s) within forty-five days said booking against execution of such cancellationa registered cancellation agreement and any other documents as may be required.
