Common use of Cancellation by the Borrower Clause in Contracts

Cancellation by the Borrower. (a) The Borrower may, by notice to IFC, irrevocably request IFC to cancel either in whole or in part the undisbursed portion of the Facility on the date specified in that notice (which shall be a date not earlier than thirty (30) days after the date of that notice); provided that the Borrower may request any such cancellation only once in any Fiscal Year. (b) IFC shall, by notice to the Borrower, cancel the undisbursed portion of the Facility effective as of that specified date if, subject to Section 3.12 (d) above IFC has received all fees and other amounts accrued (whether or not then due and payable) under this Agreement up to such specified date; and (c) Any portion of the Facility that is cancelled under this Section 3.13 may not be reborrowed.

Cancellation by the Borrower. (a) The Borrower may, by notice to IFC, irrevocably request IFC to cancel either in whole or in part the undisbursed portion of the Facility Loan on the date specified in that notice (which shall be a date not earlier than thirty (30) 30 days after the date of that notice); provided that the Borrower may request any such cancellation only once in any Fiscal Year. (b) The Borrower may, by notice to IFC, cancel the Subsequent B Loan Tranche if the Subsequent B Loan Tranche Readiness Notice has not been delivered by the date that is 45 days from the date of this Agreement. (c) IFC shall, by notice to the Borrower, cancel the undisbursed portion of the Facility Loan effective as of that specified date if, subject to Section 3.12 2.12(c) (d) above Suspension or Cancellation by IFC), IFC has received all fees and other amounts accrued (whether or not then due and payable) under this Agreement up to such specified date; and. (cd) Any portion of the Facility Loan that is cancelled under this Section 3.13 2.13 may not be reborrowedreinstated or disbursed.

(a) The Borrower may, by notice to IFCOFID, irrevocably request IFC OFID to cancel either in whole or in part the undisbursed portion of the Facility Loan on the date specified in that notice (which shall be a date not earlier than thirty (30) days after the date of that notice); provided that the Borrower may request any such cancellation only once in any Fiscal Year. (b) IFC OFID shall, by notice to the Borrower, cancel the undisbursed portion of the Facility Loan effective as of that specified date if, : (i) subject to Section 3.12 2.13 (d) above IFC c), OFID has received all fees and other amounts accrued (whether or not then due and payable) under this Agreement up to such specified date; and (ii) any amount of the Loan is then outstanding, OFID is reasonably satisfied that the Borrower has sufficient long-term funding available, on terms satisfactory to OFID to generate sufficient cash flow to pay and repay all amounts payable under this Agreement. (c) Any portion of the Facility Loan that is cancelled under this Section 3.13 2.14 may not be reborrowedreinstated or disbursed.

Cancellation by the Borrower. (a) The Borrower may, by notice to IFC, irrevocably request IFC to cancel either in whole or in part the undisbursed portion of the Facility on the date specified in that notice (which shall be a date not earlier than thirty (30) days after the date of that notice); provided that the Borrower may request any such cancellation only once in any Fiscal YearYear and the amount of any such cancellation shall be applied to the Commitments of each Tranche pro rata in accordance with amounts thereof then in effect. (b) IFC shall, by notice to the Borrower, cancel the undisbursed portion of the Facility effective as of that specified date if, subject to Section 3.12 (d3.12(d) above above, IFC has received all fees and other amounts accrued (whether or not then due and payable) under this Agreement up to such specified date; and (c) Any portion of the Facility that is cancelled under this Section 3.13 may not be reborrowedreinstated.
