In the event the escrow terminates because of the nonsatisfaction of any condition, the Parties will equally split the cancellation charges required to be paid to the Title Company. In the event this escrow terminates because of Xxxxx’s default, Buyer shall pay the cancellation charges required to be paid to the Title Company. In the event this escrow terminates because of Seller’s default, Seller shall pay the cancellation charges required to be paid to the Title Company.
