Common use of Cancellation of Surrendered Warrants Clause in Contracts

Cancellation of Surrendered Warrants. If any Warrants are exercised or transferred pursuant to Sections 3.1, 3.2.10 or 3.4, any Warrant Certificates surrendered in connection therewith shall be cancelled by the Warrant Agent, and any applicable Uncertificated Warrants shall be deemed cancelled and so noted on the Warrant register by the Warrant Agent. Upon request by the Corporation, the Warrant Agent shall furnish to the Corporation a cancellation certificate identifying the Warrant Certificates or Uncertificated Warrants so cancelled, the number of Warrants evidenced thereby, the number of Warrant Shares issued pursuant to such exercise, if applicable, and the details of any Warrant Certificates issued in substitution or exchange for such Warrant Certificates cancelled, if applicable.

Upon request by the Corporation, the Warrant Agent shall furnish to the Corporation a cancellation certificate identifying the Warrant Certificates or Uncertificated Warrants so cancelled, the number of Warrants evidenced thereby, the number of Warrant Shares Common Shares, if any, issued pursuant to such exercise, if applicable, Warrants and the details of any Warrant Certificates issued in substitution or exchange for such Warrant Certificates cancelled, if applicable.
