Common use of Cancelled Cases Clause in Contracts

Cancelled Cases. In the event a surgery is cancelled for which Customer ordered a Product from Vendor pursuant to this Agreement, Customer shall provide Vendor notice of such cancellation within twenty-four (24) hours of the scheduled surgery to avoid delivery of the Product, and if Customer fails to provide such notice, Customer shall bear responsibility for all shipping costs for such Product and the return policy provided in Section 3 shall apply.
