Common use of Cap on Liabilities for Defaults Clause in Contracts

Cap on Liabilities for Defaults. Subject to the following provisions of this Clause 5.9, a Party’s total aggregate liability to the other Party, in respect of all Loss caused by its own and its Sub- Contractors’ Defaults under or in connection with this Agreement and/or a Service Contract shall be capped at a value of two times the Overall Price.
