Common use of Capacity and Power Clause in Contracts

Capacity and Power. The Borrower has adequate capacity, power and legal right to enter into, execute, deliver and perform the terms of the Loan Documents, to borrow money, to give security for borrowings and to consummate the transactions contemplated by the Loan Documents. The execution, delivery and performance of the Loan Documents by the Borrower will not violate any law, regulation, rule or any other agreement or instrument binding on the Borrower or the Collateral.
