Capacity Limitations. In the event AstraZeneca's ability to fulfill its obligations under this Agreement is impeded by a competing agreement entered into by or on behalf of the Commission, AstraZeneca shall promptly inform the Commission. While AstraZeneca shall continue to use Best Reasonable Efforts to engage with its own contract manufacturers and suppliers to utilize the capacity and/or components, the Commission will assist in finding a mutually acceptable solution for this Agreement and the competing agreement. To the extent AstraZeneca’s performance under this Agreement is impeded by any such competing agreements, AstraZeneca shall not be deemed in breach of this Agreement as a result of any such delay due to the aforementioned competing agreement(s).

While AstraZeneca shall continue to use Best Reasonable Efforts to engage with its own contract manufacturers and suppliers to utilize the capacity and/or components, the Participating Member State will assist in finding a mutually acceptable solution for this Agreement and the competing agreement. To the extent AstraZeneca’s performance under this Agreement is impeded by any such competing agreements, AstraZeneca shall not be deemed in breach of this Agreement as a result of any such delay due to the aforementioned competing agreement(s).
Capacity Limitations. Subject to Section 5.2, Supplier shall provide all Contract Manufacturing Services in accordance with the applicable Demand Plan and Product Forecast.

Capacity Limitations. 1. A capacity limitation by gear type for fishing vessels shall apply for the duration of the recovery plan. Member States shall limit the number of fishing vessels by gear type flying their flag and authorised to fish for catch Mediterranean swordfish to the average yearly number of vessels flying their flag that fished for, retained on board, transhipped, transported, or landed Mediterranean swordfish during the period 2013-2016. by either of the following measures, whichever results in an inferior number:
(a) The average yearly number of their vessels that fished for, retained on board, transhipped, transported, or landed Mediterranean swordfish over the period 2013- 2016; or
(b) The number of their fishing vessels that fished for, retained on board, transhipped, transported, or landed Mediterranean swordfish in 2016.
2. Notwithstanding paragraph 1, Member States may decide to use the number of vessels flying their flag that fished for, retained on board, transhipped, transported or landed Mediterranean swordfish in 2016 for the purpose of calculating the capacity limitation, if this number is inferior to the average yearly number of vessels over the period 2013–2016. That limit shall be applied by gear type for fishing vessels.

Unlimited outbound domestic calling plan is capped at 1,000 minutes. Domestic overage minutes will be billed at 2.9¢ per minute. Local inbound usage will be billed at 1.0¢ per minute.
