Common use of Capital Commitment; Committed Capital Clause in Contracts

Capital Commitment; Committed Capital. A Partner’s Capital Commitment shall mean the amount that such Partner has agreed to contribute to the capital of the Partnership as set forth opposite such Partner’s name on Exhibit A hereto. The Partnership’s Committed Capital shall equal the sum of the aggregate Capital Commitments of all Partners. For the avoidance of doubt, no amounts paid by any Partner to the Corporation as a stockholder thereof prior to the Formation Date shall be considered a contribution in respect of a Partner’s Capital Commitment.

The Partnership’s “Committed Capital Capital” shall equal the sum of the aggregate Capital Commitments of all Partners. For the avoidance of doubt, no amounts paid by any Partner to the Corporation as a stockholder thereof prior to the Formation Date shall be considered a contribution in respect of a Partner’s Capital Commitment.
