Common use of Casualties or Taking of Property Clause in Contracts

Casualties or Taking of Property. Except as disclosed on Exhibit under the heading "Casualties," since September 30, 2000, neither the business nor any Property of the Borrower has been materially adversely affected as a result of any fire, explosion, earthquake, flood, drought, windstorm, accident, strike or other labor disturbance, embargo, requisition or taking of Property, or cancellation of contracts, permits, or concessions by any Governmental Authority, riot, activities of armed forces, or acts of God.

Casualties or Taking of Property. Except as disclosed on Exhibit IV under the heading "“Casualties," ” since September 30December 31, 20002005, neither the business nor any Property of the any Borrower has been materially adversely affected as a result of any fire, explosion, earthquake, flood, drought, windstorm, accident, strike or other labor disturbance, embargo, requisition or taking of Property, or cancellation of contracts, permits, or concessions by any Governmental Authority, riot, activities of armed forces, or acts of God.

Except as disclosed on Exhibit 8.16 under the heading "Casualties," since September June 30, 2000, neither the business nor any Property of the Borrower has been materially adversely affected as a result of any fire, explosion, earthquake, flood, drought, windstorm, accident, strike or other labor disturbance, embargo, requisition or taking of Property, or cancellation of contracts, permits, or concessions by any Governmental Authority, riot, activities of armed forces, or acts of God.
