Common use of Casualties or Taking of Property Clause in Contracts

Casualties or Taking of Property. Except as disclosed on Exhibit X under the heading "Casualties," since September 30, 1998, no Material Adverse Effect has occurred with respect to the business nor any Property of any Borrower as a result of any fire, explosion, earthquake, flood, drought, windstorm, accident, strike or other labor disturbance, embargo, requisition or taking of Property, or cancellation of contracts, permits, or concessions by any Governmental Authority, riot, activities of armed forces, or acts of God.

Except as disclosed on Exhibit X under the heading "Casualties," since September June 30, 19981996, no Material Adverse Effect has occurred with respect to the business nor any Property of any Borrower as a result of any fire, explosion, earthquake, flood, drought, windstorm, accident, strike or other labor disturbance, embargo, requisition or taking of Property, or cancellation of contracts, permits, or concessions by any Governmental Authority, riot, activities of armed forces, or acts of God.

Except as disclosed on Exhibit X under the heading "Casualties," since September June 30, 19982001, no Material Adverse Effect has occurred with respect to the business nor any Property of the Borrower or any Subsidiary of the Borrower as a result of any fire, explosion, earthquake, flood, drought, windstorm, accident, strike or other labor disturbance, embargo, requisition or taking of Property, or cancellation of contracts, permits, or concessions by any Governmental Authority, riot, activities of armed forces, or acts of God.
