Common use of Casualty and Other Insurance Clause in Contracts

Casualty and Other Insurance. If the Proceeds are the result of Claims described in clause 6.11.a.(iii) above or interest accrued thereon, Lender shall apply the Proceeds in the following order of priority: First, to Lender ‘s expenses in settling, prosecuting or defending the Claims; Second, to the repair or restoration of the Property; and Third, (aa) if the repair or restoration of the Property has been completed and all costs incurred in connection with the repair DEED OF TRUST (VIRGINIA) Xxxxx Fargo/Xxxx Properties/Cracker Barrel Loan No. 00-00000000/Xxxxx Xx. 000 or restoration have been paid in full, to Grantor or (bb) in all other circumstances, to the Secured Obligations in any order without suspending, extending or reducing any obligation of Grantor to make installment payments.
