Casualty Determination Clause Samples

Casualty Determination. The cost of rebuilding and repair and the number of days within which the Applicable Portion can be rebuilt or repaired (the “Estimated Repair Timeframe”) shall be determined by an independent contractor mutually acceptable to Landlord and Tenant and certified in writing to Landlord and Tenant (the “Casualty Determination”). The Casualty Determination shall be made within 60 days after the happening of the casualty.
