Ceasefire Commission Clause Samples
The Ceasefire Commission clause establishes a dedicated body responsible for monitoring, implementing, and verifying compliance with ceasefire agreements between parties. Typically, this commission is composed of representatives from the involved parties and may include neutral observers or international mediators. It oversees the reporting and investigation of alleged violations, coordinates communication between parties, and may facilitate dispute resolution related to the ceasefire. The core function of this clause is to provide a structured mechanism for maintaining peace and accountability, thereby reducing the risk of renewed hostilities and ensuring that ceasefire terms are upheld.
Ceasefire Commission a. The ceasefire, as defined in article 25 of Protocol III to the Agreement, shall take place on the date of signature of the Agreement.
b. The Ceasefire Commission provided for in article 27, paragraph 1 of Protocol III to the Agreement shall be established by the Implementation Monitoring Committee on the day the Committee starts its activities. It shall begin its work upon the appointment of its chairperson.
c. In conformity with article 27, paragraph 1 of Protocol III, the Ceasefire Commission shall consist of representatives of the Government, the combatants of the political parties and movements, the United Nations, the Organization of African Unity and the Regional Peace Initiative for Burundi.
d. The Ceasefire Commission may establish offices in the military regions of the country, as well as in the quartering locations and at other points as its functions may require.
e. The functions of the Ceasefire Commission shall be as defined in article 21, article 27, paragraphs 1(d), 2, 3 and 4 and article 28 of Protocol III of the Agreement.
f. The operations consisting of the ceasefire, disengagement, quartering and demobilization of the forces shall be completed within six months from the commencement of the activities of the Ceasefire Commission.
g. Deployment and operations of the international peacekeeping force provided for in article 27, paragraph 5 of Protocol III to the Agreement shall commence as soon as possible after the establishment of the Ceasefire Commission. They shall be conducted in coordination and cooperation with the Ceasefire Commission.
h. In performing their duties, the members of the Ceasefire Commission as well as those of the international peacekeeping and security force shall enjoy complete freedom of movement throughout the territory of Burundi.
i. The amnesty provided for in article 26(1) of Protocol III to the Agreement shall go into effect on the date of signature of the Agreement.
Ceasefire Commission. The CFC shall report to a Joint Commission consisting of the Parties, the Chadian Mediation and the international community in accordance with the sovereignty of Sudan.
Ceasefire Commission. (a) The Ceasefire Commission shall consist of representatives of the Government, the combatants of the political parties and movements, the United Nations, the Organization of African Unity and the Regional Peace Initiative for Burundi.
(b) The Ceasefire Commission shall be a decision-making body.
(c) The Ceasefire Commission shall take its decisions by consensus.
(d) The Ceasefire Commission shall be responsible, among other things, for:
(i) Establishing the location of units at the time of the ceasefire;
(ii) Establishing liaison between the parties for the purpose of the ceasefire;
(iii) Finding appropriate solutions in the event of difficulty in disengagement ;
(iv) Conducting investigations of any ceasefire violations;
(v) Verifying all information, data and activities relating to military forces of the parties;
(vi) Verifying the disengagement of the military forces of the Parties where they are in direct contact;
(vii) Monitoring the storage of arms, munitions equipment;
(viii) Monitoring the quartering of troops and police;
(ix) Undertaking the disarmament of all illegally armed civilians;
(x) Undertaking mine clearance throughout the country.
(e) The parties undertake to provide the Ceasefire Commission immediately with all relevant information on the organization, equipment and positions of their forces, on the understanding that such information shall be held in strict confidence.
Ceasefire Commission. The Ceasefire Commission shall be chaired by the AMIS Force Commander. The Deputy Commander shall be the first Vice Chair of the CFC. The European Union representative shall be the second Vice Chair of the CFC.The Parties shall give the Force Commander the necessary support to enable him/her to perform this function. The AMIS Deputy Force Commander shall be a member of the Ceasefire Commission. In the absence of the AMIS Force Commander, the Deputy Force Commander shall deputise for him/her as the Chairperson of the Commission. The AMIS Civilian Police Commissioner shall be a member of the Ceasefire Commission. The AMIS Force Commander shall establish Ceasefire Sub-Commissions in each AMIS military sector in Darfur in order to ensure a quicker cycle of investigation and reporting. The Ceasefire Sub-Commissions shall be chaired by the AMIS Sector Commanders. The Parties shall give the requisite authority to their representatives in the Ceasefire Commission to make all necessary decisions. Representatives of the European Union, the United States of America and the United Nations shall serve as Observers. The Chairperson of the Ceasefire Commission shall submit weekly reports to the Joint Commission. The Chairperson of the Ceasefire Commission shall properly establish the Commission’s Secretariat, equip it and staff it with suitably qualified persons, after informing the GoS in accordance with the Status of Mission Agreement. When the Parties are unable to reach consensus on a matter before the Ceasefire Commission, the Chairperson shall refer the matter to the Joint Commission. The Parties shall be obliged to adhere to the ruling of the Joint Commission. The Chairperson of the Ceasefire Commission shall issue regular press statements on violations of the ceasefire, following investigations of the incidents, and shall post these statements on the websites of the AU and AMIS and give copies to the Parties. Until such time as conditions are conducive to hold its meetings in El Fasher, the Joint Commission shall hold its meetings at the AU headquarters in Addis Ababa. The Joint Commission shall be chaired by the Special Representative of the Chairperson of the African Union Commission. The Joint Commission shall meet on a monthly basis; it shall issue a report after each meeting; and its members shall receive the agenda and documentation at least seven days before each meeting.
