Certain Other Property. As of the date hereof, except as set forth on Schedule 3.9, none of the Collateral constitutes: (i) Commercial Tort Claims; (ii) Documents (other than Documents related to Goods in transit); (iii) Accessions, As-Extracted Collateral, Consumer Goods, Farm Products, Manufactured Homes or standing timber; or (iv) vessels, aircraft or any other property subject to any certificate of title or other registration statute of the United States, any state or other jurisdiction, except for vehicles constituting Inventory and personal vehicles owned by any Grantor and used by employees of any Grantor in the ordinary course of business with an aggregate fair market value of less than the Minimum Actionable Amount (determined in the aggregate for all such Collateral of the Grantors).
