Certain Provisions; Specific Performance Clause Samples
The "Certain Provisions; Specific Performance" clause establishes that certain obligations within the agreement are so important that monetary damages alone would not be an adequate remedy if they are breached. In practice, this clause allows a party to seek a court order requiring the other party to fulfill their contractual duties, rather than just paying damages. Its core function is to ensure that critical terms of the contract are enforceable through specific performance, thereby providing stronger assurance that essential actions will be carried out as agreed.
