Common use of Certain Remedies for Non-payment Clause in Contracts

Certain Remedies for Non-payment. If Client fails to pay to FIS, within thirty (30) days after FIS makes written demand for the past due amount, any past-due amount payable under this Agreement (including any applicable late payment fee) that is not a Disputed Amount, in addition to all other rights and remedies which FIS may have, FIS may, in its sole discretion and with further notice to Client stating the suspension date, suspend performance of any or all of its obligations under this Agreement (other than Section 5). FIS shall have no liability for Client’s use of the Solution until all such past-due amounts and any applicable reinstatement fees are paid in full.
