Certification Regarding Sales and Use Tax. By executing this Agreement, Grantee certifies it is either (1) registered with the Iowa Office of Revenue, collects, and remits Iowa sales and use taxes as required by Iowa Code chapter 423; or (2) not a “retailer” or a “retailer maintaining a place of business in this state” as those terms are defined in Iowa Code § 423.1(47) and (48). Tobacco Free Environment. Grantee agrees that it will not allow smoking or tobacco use within any portion of any indoor facility it leases, rents, or owns, and over which it has the authority to establish policy. Grantee agrees that it shall comply with Iowa’s Smokefree Air Act, contained at Iowa Code chapter 142D.
