Changes by the Employer. If the Employer determines the Plan may fail to satisfy any non-discrimination requirements imposed by the Code, the Employer shall take any action it deems appropriate to assure compliance with such requirement, to include, without limitation, a modification of elections by Highly Compensated Participants with or without their permission.
