Changes in Subscriber Carrier Selection. 15.1 Each Party will abide by applicable state or federal laws and regulations in obtaining End User authorization prior to changing End User’s Spectrotel to itself and in assuming responsibility for any applicable charges as specified in § 258 (b) of the Telecommunications Act of 1996. Either Party shall make authorization available to the other Party upon request and at no charge. 15.2 Either Party can initiate a challenge to a change in its local exchange service provider. If an End User notifies either Party that the End User requests local exchange service, the Party receiving such request shall be free to immediately provide service to such End User. 15.3 When an End User changes or withdraws authorization, each Party will release Customer specific facilities in accordance with the Customers’ direction or the End User’s authorized agent. Further, when an End User abandons the premise, Windstream is free to reclaim the facilities for use by another Customer and is free to issue service orders required to reclaim such facilities. 15.4 Subject to applicable rules, orders, and decisions, Windstream will provide Spectrotel with access to Customer Proprietary Network Information (“CPNI”) for Windstream End Users upon Spectrotel providing Windstream a signed Letter of Authorization (“LOA”) for Windstream’s Customer of record. 15.4.1 The Parties agree that they will conform to FCC and/or state regulations regarding the information provided on the LOA, the provisioning of CPNI between the Parties, and regarding the use of that information by the requesting Party. 15.4.2 The requesting Party will document End User permission obtained to receive CPNI, whether or not the End User has agreed to change Local Service Providers. 15.4.3 CPNI requests will be processed and responded to by each Party in parity. Spectrotel will provide the same CPNI to Windstream that Windstream provides Spectrotel. 15.4.4 If the Parties do not agree that Spectrotel requested CPNI for a specific End User, or that Windstream has erred in not accepting proof of an LOA, the Parties may immediately request dispute resolution in accordance with Section 6.0, Dispute Resolution, of Attachment 2, (Resale). 15.5 Windstream will only accept an LOA for a Windstream Customer of record. Spectrotel may not delegate its obligation to obtain written authorization from Windstream’s Customer of record to a third party.

For end users changing service from one Party to the other, specific end user LOAs may be requested by the Party receiving CPNI requests to investigate possible slamming incidents, and for other reasons agreed to by the Parties. The receiving Party may also request documentation of an LOA if CPNI is requested and a subsequent service order for the change of local service is not received. 15.4.3 17.4.3 CPNI requests will be processed and responded to by each Party in parity. Spectrotel will provide accordance with the same CPNI to Windstream that Windstream provides Spectrotelfollowing: 17.4.3.1 For customers with 1-25 lines: two (2) business days. 15.4.4 17.4.3.2 For customers with 26+ lines: three (3) business days. 17.4.4 If the Parties do not agree that Spectrotel ICG requested CPNI for a specific End Userend user, or that Windstream ALLTEL has erred in not accepting proof of an LOA, the Parties may immediately request dispute resolution in accordance with Section 6.0General Terms & Conditions, §9.0, Dispute Resolution, of Attachment 2, (Resale). 15.5 Windstream will only accept an LOA for a Windstream Customer of record. Either Each Party shall make authorization available deliver to the other Party upon a representation of authorization that applies to all orders submitted by a Party under this Agreement requiring a LEC change. A Party's representation of authorization shall be delivered to the other Party prior to the first order submitted to the other Party. Each Party shall retain on file all applicable letters and other documentation of authorization relating to its End User’s selection of such Party as its LEC, which documentation shall be available for inspection by the other Party at its request during normal business hours and at no charge. 15.2 Either Party 21.2 Only an End User can initiate a challenge to a change in its local exchange service providerLocal Exchange Carrier. For End Users changing service from one Party to the other, specific End User LOAs may be requested by the Party receiving CPNI requests to investigate possible slamming incidents, and for other reasons agreed to by the Parties. Changes in Subscriber Carrier Selection. 15.1 Each 17.1 With respect to Resale services and unbundled Network Elements provided to end users, each Party will abide by applicable state or federal laws and regulations in obtaining End User must obtain end user authorization prior to changing End User’s Spectrotel requesting a change in the end users' provider of local exchange service (including ordering end user specific Network Elements) and must retain such authorizations for twelve (12) months. Spectrotel will provide accordance with the same CPNI to Windstream that Windstream provides Spectrotelfollowing: 15.4.3.1 For customers with 1-25 lines: two (2) business days. 15.4.3.2 For customers with 26+ lines: three (3) business days. 15.4.4 If the Parties do not agree that Spectrotel FLATEL requested CPNI for a specific End Userend user, or that Windstream ALLTEL has erred in not accepting proof of an LOA, the Parties may immediately request dispute resolution in accordance with Section 6.0, Dispute Resolution, of Attachment 2, (Resale). 15.5 Windstream ALLTEL will only accept an LOA for a Windstream Customer an ALLTEL customer of record.
