Changes in Subscriber Carrier Selection. 15.1 Each Party will abide by applicable state or federal laws and regulations in obtaining End User authorization prior to changing End User’s Spectrotel to itself and in assuming responsibility for any applicable charges as specified in § 258 (b) of the Telecommunications Act of 1996. Either Party shall make authorization available to the other Party upon request and at no charge. 15.2 Either Party can initiate a challenge to a change in its local exchange service provider. Further, when an End User abandons the premise, Windstream is free to reclaim the facilities for use by another Customer and is free to issue service orders required to reclaim such facilities. 15.4 Subject to applicable rules, orders, and decisions, Windstream will provide Spectrotel with access to Customer Proprietary Network Information (“CPNI”) for Windstream End Users upon Spectrotel providing Windstream a signed Letter of Authorization (“LOA”) for Windstream’s Customer of record. 15.4.1 The Parties agree that they will conform to FCC and/or state regulations regarding the information provided on the LOA, the provisioning of CPNI between the Parties, and regarding the use of that information by the requesting Party. 15.4.2 The requesting Party will document End User permission obtained to receive CPNI, whether or not the End User has agreed to change Local Service Providers. 15.4.3 CPNI requests will be processed and responded to by each Party in parity. Spectrotel will provide the same CPNI to Windstream that Windstream provides Spectrotel. 15.4.4 If the Parties do not agree that Spectrotel requested CPNI for a specific End User, or that Windstream has erred in not accepting proof of an LOA, the Parties may immediately request dispute resolution in accordance with Section 6.0, Dispute Resolution, of Attachment 2, (Resale). 15.5 Windstream will only accept an LOA for a Windstream Customer of record. For end users changing service from one Party to the other, specific end user LOAs may be requested by the Party receiving CPNI requests to investigate possible slamming incidents, and for other reasons agreed to by the Parties. The receiving Party may also request documentation of an LOA if CPNI is requested and a subsequent service order for the change of local service is not received. 15.4.3 17.4.3 CPNI requests will be processed and responded to by each Party in parity. Either Each Party shall make authorization available deliver to the other Party upon a representation of authorization that applies to all orders submitted by a Party under this Agreement requiring a LEC change. A Party's representation of authorization shall be delivered to the other Party prior to the first order submitted to the other Party. Each Party shall retain on file all applicable letters and other documentation of authorization relating to its End User’s selection of such Party as its LEC, which documentation shall be available for inspection by the other Party at its request during normal business hours and at no charge. 15.2 Either Party 21.2 Only an End User can initiate a challenge to a change in its local exchange service providerLocal Exchange Carrier. Further, when an End User abandons the premise, Windstream (that is, its place of business or domicile), SBC MISSOURI is free to reclaim the facilities Lawful Unbundled Network Elements for use by another Customer End User and is free to issue service orders required to reclaim such facilitiesLawful Unbundled Network Elements. 15.4 Subject 21.4 Neither Party shall be obligated by this Agreement to applicable rules, orders, and decisions, Windstream will provide Spectrotel with access to Customer Proprietary Network Information investigate any allegations of unauthorized changes in local Exchange Service (“CPNIslamming”) for Windstream End Users upon Spectrotel providing Windstream a signed Letter at the request of Authorization (“LOA”) for Windstream’s Customer of record. 15.4.1 The Parties agree the other Party, provided, however, that they will conform to FCC and/or state regulations regarding the information provided on the LOA, the provisioning of CPNI between the Parties, and regarding the use of that information by the requesting Party. 15.4.2 The requesting Party will document End User permission obtained to receive CPNI, whether or not the End User has agreed to change Local Service Providers. 15.4.3 CPNI requests will be processed and responded to by each Party shall cooperate with any investigation of a complaint alleging an unauthorized change in parity. For End Users changing service from one Party to the other, specific End User LOAs may be requested by the Party receiving CPNI requests to investigate possible slamming incidents, and for other reasons agreed to by the Parties. For End Users changing service from one Party to the other, specific End User LOAs may be requested by the Party receiving CPNI requests to investigate slamming complaints, and for other reasons agreed to by the Parties. 15.4.3 17.4.3 CPNI requests will be processed and responded to by each Party in parity. Spectrotel Insight may not delegate its obligation to obtain written authorization from Windstream’s Customer of record to a third partyparty only after Insight has provided Windstream a Letter of Agency on Insight letterhead, and signed by an authorized Insight representative identifying the third party name, and specific functions by state the third party is authorized to perform on behalf of Insight.

For end users changing service from one Party to the other, specific end user LOAs may be requested by the Party receiving CPNI requests to investigate possible slamming incidents, and for other reasons agreed to by the Parties. MCIm’s obligation to obtain written authority prior to accessing CPNI electronically, as set forth in the preceding provisions, is subject to modification in accordance with any governing regulatory decisions expressly addressing this subject matter. 17.6 XXXx will obtain authorization from Windstream’s Customer for change in local exchange service and release of record CPNI that adheres to a third partyall requirements of state and federal law, as applicable CPNI, includes customer name, billing and service address, billing telephone number(s), any and all exemption status or current status of eligibility for reduced charges, and identification of features and services subscribed to by customer.

Changes in Subscriber Carrier Selection. 15.1 17.1 Each Party will abide by applicable state or federal laws and regulations in obtaining End User authorization prior to changing End User’s Spectrotel Local Service Provider to itself and in assuming responsibility for any applicable charges as specified in § §258 (b) of the Telecommunications Act of 1996. If an End User notifies either Party that the End User requests local exchange service, the Party receiving such request shall be free to immediately provide service to such End User. 15.3 17.3 When an End User changes or withdraws authorization, each Party will release Customer specific facilities in accordance with the Customers’ direction or the End User’s authorized agent. Further, when an End User abandons the premise, Windstream is free to reclaim the facilities for use by another Customer and is free to issue service orders required to reclaim such facilities. 15.4 17.4 Subject to applicable rules, orders, and decisions, Windstream will provide Spectrotel Service Electric with access to Customer Proprietary Network Information (“CPNI”) for Windstream End Users upon Spectrotel providing Windstream Service Electric affirmation that Service Electric has obtained a signed Letter of Authorization Agency (“LOA”) for Windstream’s Customer of record. . Service Electric will provide such Letter of Authorization upon request from Windstream. 15.4.1 17.4.1 The Parties agree that they will conform to FCC and/or state regulations regarding the information provided on the LOA, the provisioning of CPNI between the Parties, and regarding the use of that information by the requesting Party. 15.4.2 17.4.2 The requesting Party will document End User permission obtained to receive CPNI, whether or not the End User has agreed to change Local Service Providers. 15.4.3 CPNI requests will be processed and responded to by each Party in parity. Spectrotel will provide the same CPNI to Windstream that Windstream provides Spectrotel. 15.4.4 If the Parties do not agree that Spectrotel Service Electric requested CPNI for a specific End User, or that Windstream has erred in not accepting proof of an LOA, the Parties may immediately request dispute resolution in accordance with General Terms & Conditions, Section 6.09.0, Dispute Resolution, of Attachment 2, (Resale). 15.5 17.4.3 CPNI requests will be processed and responded to by each Party in parity. Service Electric will provide the same CPNI to Windstream that Windstream provides Service Electric. 17.5 Windstream will only accept an LOA for a Windstream Customer of recordrecord . Spectrotel Service Electric may not delegate its obligation to obtain written authorization from Windstream’s Customer of record to a third party.

Dialog Telecommunications will provide such Letter of Authorization upon request from Windstream. 15.4.1 17.4.1 The Parties agree that they will conform to FCC and/or state regulations regarding the information provided on the LOA, the provisioning of CPNI between the Parties, and regarding the use of that information by the requesting Party. 15.4.2 17.4.2 The requesting Party will document End User permission obtained to receive CPNI, whether or not the End User has agreed to change Local Service Providers. 15.4.3 CPNI requests will be processed and responded to by each Party in parity. Spectrotel will provide the same CPNI to Windstream that Windstream provides Spectrotel. 15.4.4 If the Parties do not agree that Spectrotel Dialog Telecommunications requested CPNI for a specific End User, or that Windstream has erred in not accepting proof of an LOA, the Parties may immediately request dispute resolution in accordance with General Terms & Conditions, Section 6.09.0, Dispute Resolution, of Attachment 2, (Resale). 15.5 17.4.3 CPNI requests xxxx be processed and responded to by each Party in parity. Dialog Telecommunications will provide the same CPNI to Windstream that Windstream provides Dialog Telecommunications. 17.5 Windstream will only accept an LOA for a Windstream Customer of recordrecord . Spectrotel Dialog Telecommunications may not delegate its obligation to obtain written authorization from Windstream’s Customer of record to a third party.

Spectrotel Xxxxx will provide the same CPNI to Windstream that Windstream provides SpectrotelXxxxx. 15.4.4 If the Parties do not agree that Spectrotel Xxxxx requested CPNI for a specific End User, or that Windstream has erred in not accepting proof of an LOA, the Parties may immediately request dispute resolution in accordance with Section 6.0, Dispute Resolution, of Attachment 2, (Resale). 15.5 Windstream will only accept an LOA for a Windstream Customer of record. Spectrotel Xxxxx may not delegate its obligation to obtain written authorization from Windstream’s Customer of record to a third party.

Further, when an End User end user abandons the premise, Windstream ALLTEL is free to reclaim the facilities for use by another Customer customer and is free to issue service orders required to reclaim such facilities. 15.4 Subject to applicable rules, orders, and decisions, Windstream ALLTEL will provide Spectrotel Networks City with access to Customer Proprietary Network Information (“CPNI”) for Windstream End Users ALLTEL end users upon Spectrotel Networks City providing Windstream ALLTEL a signed Letter of Authorization Agency (“LOA”) for WindstreamALLTEL’s Customer customer of record, based on Networks City’s representation that subscriber has authorized Networks City to obtain such CPNI. 15.4.1 The Parties agree that they will conform to FCC and/or state regulations regarding the information provided on the LOA, the provisioning of CPNI between the Parties, and regarding the use of that information by the requesting Party. 15.4.2 The requesting Party will document End User end user permission obtained to receive CPNI, whether or not the End User end user has agreed to change Local Service Providers. For end users changing service from one Party to the other, specific end user LOAs may be requested by the Party receiving CPNI requests to investigate possible slamming incidents, and for other reasons agreed to by the Parties. The receiving Party may also request documentation of an LOA if CPNI is requested and a subsequent service order for the change of local service is not received. 15.4.3 CPNI requests will xxxx be processed and responded to by each Party in parity. Spectrotel will provide accordance with the same CPNI to Windstream that Windstream provides Spectrotelfollowing: 15.4.3.1 For customers with 1-25 lines: two (2) business days. 15.4.3.2 For customers with 26+ lines: three (3) business days. 15.4.4 If the Parties do not agree that Spectrotel Networks City requested CPNI for a specific End Userend user, or that Windstream ALLTEL has erred in not accepting proof of an LOA, the Parties may immediately request dispute resolution in accordance with Section 6.0, Dispute Resolution, of Attachment 2, (Resale). 15.5 Windstream ALLTEL will only accept an LOA for a Windstream Customer an ALLTEL customer of record. Spectrotel Networks City may not delegate its obligation to obtain written authorization from WindstreamALLTEL’s Customer customer of record to a third party.

Changes in Subscriber Carrier Selection. 15.1 Each 17.1 With respect to Resale services and unbundled Network Elements provided to end users, each Party will abide by applicable state or federal laws and regulations in obtaining End User must obtain end user authorization prior to changing End User’s Spectrotel requesting a change in the end users' provider of local exchange service (including ordering end user specific Network Elements) and must retain such authorizations for twelve (12) months. The authorization must conform with federal rules regarding changes of presubscribed interexchange carriers until such time as there are federal or state rules applicable to itself and in assuming changes of local exchange service providers. Thereafter, the authorization must comply with each such rule. The Party submitting the change request assumes responsibility for any applicable charges as specified in § 258 (bSection 258(b) of the Telecommunications Act of 1996. Either Party shall make authorization available to the other Party upon request and at no charge. 15.2 Either Party 17.2 Only an end user can initiate a challenge to a change in its local exchange service provider. In connection with such challenges each Party will follow procedures which conform with federal rules regarding challenges to changes of presubscribed interexchange carriers until such time as there are federal or state rules applicable to challenges to changes of Local Exchange Service Providers. Thereafter, the procedures each Party will follow concerning challenges to changes of local exchange service providers will comply with such rule. If an End User notifies either Party end user notified SWBT or CLEC that the End User end user requests local exchange service, the Party receiving such request shall be free to immediately provide service to such End Userend user. SWBT shall be free to connect the end user to any local service provider based upon the local service provider’s request and assurance that proper end user authorization has been obtained. CLEC shall make authorization available to SWBT upon request and at no charge. 15.3 17.3 When an End User end user changes or withdraws authorization, each Party will release Customer customer specific facilities in accordance with the Customers’ direction end user customer’s directions, or the End Userdirections of the end user’s authorized agent. Further, when an End User end user abandons the premise, Windstream SWBT is free to reclaim the facilities for use by another Customer customer and is free to issue service orders required to reclaim such facilities. 15.4 Subject 17.4 Neither Party shall be obligated by this Agreement to applicable rules, orders, and decisions, Windstream will provide Spectrotel with access to Customer Proprietary Network Information investigate any allegations of unauthorized changes in local exchange service (“CPNIslamming”) for Windstream End Users upon Spectrotel providing Windstream a signed Letter on behalf of Authorization (“LOA”) for Windstream’s Customer of record. 15.4.1 The Parties agree that they will conform to FCC and/or state regulations regarding the information provided on the LOA, the provisioning of CPNI between the Parties, and regarding the use of that information by the requesting Party. 15.4.2 The requesting other Party will document End User permission obtained to receive CPNI, whether or not the End User has agreed to change Local Service Providers. 15.4.3 CPNI requests will be processed and responded to by each Party in parity. Spectrotel will provide the same CPNI to Windstream that Windstream provides Spectrotel. 15.4.4 If the Parties do not agree that Spectrotel requested CPNI for a specific End User, or that Windstream has erred in not accepting proof of an LOA, the Parties may immediately request dispute resolution in accordance with Section 6.0, Dispute Resolution, of Attachment 2, (Resale). 15.5 Windstream will only accept an LOA for a Windstream Customer of record. Spectrotel may not delegate its obligation to obtain written authorization from Windstream’s Customer of record to a third party. If SWBT, on behalf of CLEC, agrees to investigate an alleged incidence of slamming, SWBT shall charge CLEC a cost-based or mutually agreed investigation fee.

Further, when an End User abandons the premise, Windstream is free to reclaim the facilities for use by another Customer and is free to issue service orders required to reclaim such facilities. 15.4 17.4 Subject to applicable rules, orders, and decisions, Windstream ALLTEL will provide Spectrotel TCG with access to Customer Proprietary Network Information (“CPNI”) for Windstream End Users ALLTEL end users upon Spectrotel TCG providing Windstream ALLTEL a signed Letter of Authorization Agency (“LOA”) for Windstream), based on TCG’s Customer of recordrepresentation that subscriber has authorized TCG to obtain such CPNI. 15.4.1 17.4.1 The Parties agree that they will conform to FCC and/or state regulations regarding the information provided on the LOA, the provisioning of CPNI between the Parties, and regarding the use of that information by the requesting Party. 15.4.2 17.4.2 The requesting Party will document End User end user permission obtained to receive CPNI, whether or not the End User end user has agreed to change Local Service Providers. For end users changing service from one Party to the other, specific end user LOAs may be requested by the Party receiving CPNI requests to investigate possible slamming incidents, and for other reasons agreed to by the Parties. The receiving Party may also request documentation of an LOA if CPNI is requested and a subsequent service order for the change of local service is not received. 15.4.3 17.4.3 CPNI requests will be processed and responded to by each Party in parity. For End Users changing service from one Party to the other, specific End User LOAs may be requested by the Party receiving CPNI requests to investigate possible slamming incidents, and for other reasons agreed to by the Parties. The receiving Party may also request documentation of an LOA if CPNI is requested and a subsequent service order for the change of local service is not received. 15.4.3 17.4.3 CPNI requests will be processed and responded to by each Party in parity. Further, when an End User end user abandons the premise, Windstream ALLTEL is free to reclaim the facilities for use by another Customer customer and is free to issue service orders required to reclaim such facilities. 15.4 Subject to applicable rules, orders, and decisions, Windstream ALLTEL will provide Spectrotel FLATEL with access to Customer Proprietary Network Information (“CPNI”) for Windstream End Users ALLTEL end users upon Spectrotel FLATEL providing Windstream ALLTEL a signed Letter of Authorization Agency (“LOA”) for WindstreamXXXXXX’s Customer customer of record, based on FLATEL’s representation that subscriber has authorized FLATEL to obtain such CPNI. 15.4.1 The Parties agree that they will conform to FCC and/or state regulations regarding the information provided on the LOA, the provisioning of CPNI between the Parties, and regarding the use of that information by the requesting Party. 15.4.2 The requesting Party will document End User end user permission obtained to receive CPNI, whether or not the End User end user has agreed to change Local Service Providers. For end users changing service from one Party to the other, specific end user LOAs may be requested by the Party receiving CPNI requests to investigate possible slamming incidents, and for other reasons agreed to by the Parties. TWCIS (KY) will provide such Letter of Authorization (“LOA”) for upon request from Windstream’s Customer of record. 15.4.1 17.4.1 The Parties agree that they will conform to FCC and/or state regulations regarding the information provided on the LOA, the provisioning of CPNI between the Parties, and regarding the use of that information by the requesting Party. 15.4.2 17.4.2 The requesting Party will document End User permission obtained to receive CPNI, whether or not the End User has agreed to change Local Service Providers. 15.4.3 CPNI requests will be processed and responded to by each Party in parity. Spectrotel will provide the same CPNI to Windstream that Windstream provides Spectrotel. 15.4.4 If the Parties do not agree that Spectrotel TWCIS (KY) requested CPNI for a specific End User, or that Windstream has erred in not accepting proof of an LOA, the Parties may immediately request dispute resolution in accordance with General Terms & Conditions, Section 6.09.0, Dispute Resolution, of Attachment 2, (Resale). 15.5 17.5 Windstream will only accept an LOA for a Windstream Customer of recordrecord or other authorized individual. Spectrotel TWCIS (KY) may not delegate its obligation to obtain written authorization from Windstream’s Customer of record to a third party.

Either Party shall make authorization available to the other Party upon request reasonable requests and at no charge. 15.2 Either Party 17.2 Only an end user can initiate a challenge to a change in its local exchange service provider. If an End User end user notifies either Party that the End User end user requests local exchange service, the Party receiving such request shall be free to immediately provide service to such End Userend user. 15.3 17.3 When an End User end user changes or withdraws authorization, each Party will release Customer customer specific facilities in accordance with the Customersend user customers’ direction or the End Userend user’s authorized agent. Further, when an End User abandons the premise, Windstream is free to reclaim the facilities for use by another Customer and is free to issue service orders required to reclaim such facilities. 15.4 17.4 Subject to applicable rules, orders, and decisions, Windstream ALLTEL will provide Spectrotel KMC with access to Customer Proprietary Network Information (“CPNI”) for Windstream End Users ALLTEL end users upon Spectrotel KMC providing Windstream ALLTEL a signed Letter of Authorization Agency (“LOA”) for Windstream), based on KMC’s Customer of recordrepresentation that subscriber has authorized KMC to obtain such CPNI. 15.4.1 17.4.1 The Parties agree that they will conform to FCC and/or state regulations regarding the information provided on the LOA, the provisioning of CPNI between the Parties, and regarding the use of that information by the requesting Party. 15.4.2 17.4.2 The requesting Party will document End User end user permission obtained to receive CPNI, whether or not the End User end user has agreed to change Local Service Providers. 15.4.3 . For end users changing service from one Party to the other, specific end user LOAs may be requested by the Party receiving CPNI requests will be processed to investigate possible slamming incidents, and responded for other reasons agreed to by each the Parties. Spectrotel will provide the same CPNI to Windstream that Windstream provides Spectrotel. 15.4.4 If the Parties do not agree that Spectrotel requested CPNI for a specific End User, or that Windstream has erred in not accepting proof may also request documentation of an LOA, LOA if CPNI is requested and a subsequent service order for the Parties may immediately request dispute resolution in accordance with Section 6.0, Dispute Resolution, change of Attachment 2, (Resale)local service is not received. 15.5 Windstream will only accept an LOA for a Windstream Customer of record. Peerless will provide such Letter of Authorization (“LOA”) for upon request from Windstream’s Customer of record. 15.4.1 17.4.1 The Parties agree that they will conform to FCC and/or state regulations regarding the information provided on the LOA, the provisioning of CPNI between the Parties, and regarding the use of that information by the requesting Party. 15.4.2 17.4.2 The requesting Party will document End User permission obtained to receive CPNI, whether or not the End User has agreed to change Local Service Providers. 15.4.3 CPNI requests will be processed and responded to by each Party in parity. NebraskaLink will provide the same CPNI to Windstream that Windstream provides NebraskaLink. 17.5 Windstream will only accept an LOA for a Windstream Customer of record. Spectrotel NebraskaLink may not delegate its obligation to obtain written authorization from Windstream’s Customer of record to a third party.

For end users changing service from one Party to the other, specific end user LOAs may be requested by the Party receiving CPNI requests to investigate possible slamming incidents, and for other reasons agreed to by the Parties. The receiving Party may also request documentation of an LOA if CPNI is requested and a subsequent service order for the change of local service is not received. 15.4.3 17.4.3 CPNI requests will xxxx be processed and responded to by each Party in parity. Spectrotel will provide accordance with the same CPNI to Windstream that Windstream provides Spectrotelfollowing: 17.4.3.1 For customers with 1-25 lines: two (2) business days. 15.4.4 17.4.3.2 For customers with 26+ lines: three (3) business days. 17.4.4 If the Parties do not agree that Spectrotel Xxxx requested CPNI for a specific End Userend user, or that Windstream has erred in not accepting proof of an LOA, the Parties may immediately request dispute resolution in accordance with Section 6.0General Terms & Conditions, §9.0, Dispute Resolution, of Attachment 2, (Resale). 15.5 17.5 Windstream will only accept an LOA for a an Windstream Customer customer of record. For end users changing service from one Party to the other, specific end user LOAs may be requested by the Party receiving CPNI requests to investigate possible slamming incidents, and for other reasons agreed to by the Parties.
