Changes to Approved Working Drawings Clause Samples
The "Changes to Approved Working Drawings" clause governs the process for modifying construction drawings that have already received formal approval. Typically, this clause outlines the steps required for requesting, reviewing, and authorizing any alterations to these drawings, such as submitting revised plans for approval or obtaining written consent from relevant parties. Its core function is to ensure that all changes are properly documented and agreed upon, thereby preventing unauthorized modifications and minimizing disputes over the scope or quality of the work.
Changes to Approved Working Drawings. Without limiting Tenant’s right to make Minor Variations to the Approved Working Drawings without Landlord’s approval, Tenant shall also have the right to modify the Approved Working Drawings with Landlord’s prior written approval, which approval shall be granted unless the requested modification would cause a Design Problem. Tenant shall request such modifications to the Approved Working Drawings by notifying Landlord in writing, in substantially the same form as the AIA standard change order form (a “Tenant Change Order Request”), which Tenant Change Order Request shall detail the nature and extent of any such modification and shall be signed by Tenant's Representative and the Contractor of the applicable Project. Landlord shall use commercially reasonable efforts to approve or reasonably disapprove such Tenant Change Order Request no later than five (5) business days after Landlord's receipt thereof, with any such disapproval of a Tenant Change Order Request to specify the reasonable basis for such disapproval accompanied by a written detailed description of changes by Landlord. If Landlord approves a Tenant Change Order Request, Tenant may cause the Approved Working Drawings to be modified accordingly. If Landlord fails to respond with Landlord's approval or reasonable disapproval (in accordance with the terms and conditions of this Section 3.6) within such five (5) business day period, then the terms of Section 3.7, below, shall be applicable.
Changes to Approved Working Drawings. In the event that Tenant requests any changes to the Approved Working Drawings (“Changes”), Landlord shall grant its consent to such Changes within three (3) business days after Landlord’s receipt of Tenant’s request for the same, provided the Change does not create a Design Problem. Any actual delay in the Substantial Completion of the Tenant Improvements caused by any such Changes requested by Tenant, and authorized to be implemented by Tenant pursuant to this Section 3.6, shall constitute a Tenant Delay.
Changes to Approved Working Drawings. In the event Tenant desires to change the Approved Working Drawings, Tenant shall deliver notice of the same to Landlord, setting forth in detail the changes Tenant desires to make to the Approved Working Drawings. Landlord shall, within five (5) business days of receipt thereof, either (i) approve the Tenant Change or (ii) reasonably disapprove the Tenant Change and deliver a notice to Tenant specifying in detail the reasons for Landlord's disapproval. Landlord may withhold its consent, in its sole discretion, to any change in the Approved Working Drawings if such change would directly or indirectly delay the "Substantial Completion", as that term is defined in Section 5.1 of this Tenant Work Letter, of the Tenant Improvements. Tenant shall pay any additional costs that arise in connection with such Tenant Change.
Changes to Approved Working Drawings. Any changes to the Approved Working Drawings approved by Landlord (each, a “Change”) shall be requested and instituted in accordance with the provisions of this Section 2.5 and shall be subject to the written approval of the non-requesting party in accordance with this Work Agreement.
Changes to Approved Working Drawings. In the event Tenant desires to change the Approved Working Drawings, Tenant shall deliver notice of the same to Landlord, setting forth in detail the changes Tenant desires to make to the Approved Working Drawings. Landlord shall, within five (5) business days of receipt thereof, either (i) approve the Tenant Change or (ii) disapprove the Tenant Change and deliver a notice to Tenant specifying in detail the reasons for Landlord's disapproval. In the event that such changes would directly or indirectly delay the "Substantial Completion", as that term is defined in Section 5.1 of this Tenant Work Letter, of Tenant's improvements, such delay shall be deemed to be a Tenant delay under Section 5.4Tenant shall pay any additional costs that arise in connection with such Tenant Change.
Changes to Approved Working Drawings. In the event that Tenant requests any changes or substitutions to the Approved Working Drawings ("Changes"), Landlord shall not unreasonably withhold or condition its consent to any such Changes, and shall grant its consent to such Changes within five (5) business days after Landlord's receipt of Tenant's request for the same, provided the Change does not create a Design Problem.
