The "Changes to run descriptions" clause defines the process and conditions under which modifications can be made to the descriptions of specific runs or activities outlined in an agreement. Typically, this clause specifies who has the authority to propose or approve changes, the required notice period, and any documentation or communication protocols that must be followed. For example, it may allow either party to request updates to the scope or details of a scheduled run, provided that such changes are agreed upon in writing. The core function of this clause is to provide a clear and structured method for updating operational details, thereby reducing misunderstandings and ensuring that both parties remain aligned as circumstances evolve.
Changes to run descriptions. Run descriptions can only be changed with the agreement of affected RMOs as follows:
(a) Agreement with the affected RMOs will be sought by applying the overarching principles for change management set out in Part A of Schedule Nine.
(b) Any agreement to change will be assessed by vote. The vote shall be conducted as follows: • Only affected RMOs may vote • The period for voting shall be clearly set out and once the period is closed no further votes can be submitted • Voting will be conducted on-line and shall be anonymous. If on-line voting is not practicable and the affected RMOs accept that some other form of voting is appropriate, then an alternative method of voting can be used.
(c) Change will only proceed if 2/3rds of the affected RMOs who participate in the vote, vote in favour of the change – this means obtaining the threshold number of votes set out below, if the number of votes is 20 or less: Number of RMOS voting Threshold required to agree 1 to 2 Unanimous 4 to 5 3 6 4 7 to 8 5 9 6 10 to 11 7 12 8 13 to 14 9 15 10 16 to 17 11 18 12 19 to 20 13
(d) Affected RMOs are those whom the proposed change will affect at the time it is implemented.
(e) Generally, this change proposal process will not be initiated in November or December.
(f) Following agreement to change under this process, a copy of the new run description shall be forwarded to the NZRDA.
Changes to run descriptions. Run descriptions shall not be changed without the agreement of two thirds (66.67%) the RMO(s) concerned. For the purposes of this clause, “RMOs concerned” are those whom the change affects at the time it is implemented. Following agreement to the change, a copy of the new Run Description incorporating the change shall be provided to the RMOs concerned and the NZRDA.
