Common use of Changes via Electronic Communication Clause in Contracts

Changes via Electronic Communication. Upon approval from Agency, the following changes to the Contract may be accomplished by electronic communication (email acceptable) that document agreement by Contractor and Agency and may be considered as administration of the Contract and not an amendment: a. Updates to Contractor’s Contract Administrator or Agency’s Contract Administrator. b. Changes to Key Person(s). c. Substitutions or changes to subcontractors. d. Transfers of funding between staff, between labor and other direct costs, and/or between tasks, provided this does not result in an increase to the overall NTE of the Contract. e. Schedule modifications to Exhibit A-2 (Deliverable Plan). All other modifications to Exhibit A-2, including increased fees, must be issued by a formal amendment. f. Modifications to Exhibit D (Contractor’s Hourly Rates), provided this does not result in an increase to the overall NTE of the Contract.
