Common use of Chapter 11 Claims Clause in Contracts

Chapter 11 Claims. No Credit Party shall incur, create, assume, suffer to exist or permit any administrative expense, unsecured claim, or other super-priority claim or lien that is pari passu with or senior to the claims of the Lenders against the Credit Parties, or apply to the Bankruptcy Court for authority to do so, except for the Carve-Out and the pari passu liens of Citibank on the Collateral (other than the Prepetition Collateral) with respect to its Purchase Price Overpayment Secured Claim to the extent set forth in the Order.

Chapter 11 Claims. No Credit Party shall incur, create, assume, suffer to exist or permit any administrative expense, unsecured claim, or other super-priority administrative claim or lien that which is pari passu with or senior to the claims of the Agents and Lenders against Borrowers and the other Credit Parties, or apply to the Bankruptcy Court for authority to do so, except for the Carve-Out and the pari passu liens of Citibank on the Collateral (other than the Prepetition Collateral) with respect to its Purchase Price Overpayment Secured Claim to the extent as set forth in the OrderSection 2.24.

No Credit Party shall, nor shall incurit permit any of its Subsidiaries to, create, assume, suffer to exist or permit any administrative expense, unsecured claim, or other super-priority administrative claim or lien that is pari passu with or senior to the claims Claims of the Lenders Secured Parties against the Credit Parties, or apply to the Bankruptcy Court for authority to do so, except for the Carve-Out and the pari passu liens of Citibank on the Collateral (other than the Prepetition Collateral) with respect to its Purchase Price Overpayment Secured Claim to the extent as set forth in the Interim Order and the Final Order, as then in effect.
