Charges, Fees and Assessments. Any and all applicable charges, fees and assessments pending as of the date of this Agreement and any and all other sums due under declarations, cross-easements and like agreements to which the Property or any portion thereof may be subject, have been paid, and no special assessments thereunder are pending, and all consents and approvals required to be obtained under any such declarations, cross-easements and like agreements have been obtained pursuant to the requirements of such documentation. The representation contained in this Section 5.20 shall be true at and as of Closing.
