Common use of Charter Assignment Clause in Contracts

Charter Assignment. The Borrower shall ensure that if the Owner enters into a bareboat charter or a time charter in respect of the Ship which is of 12 or more months in duration, or is capable of exceeding 12 months in duration, the Owner shall, at the request of the Agent, execute in favour of the Lenders a first priority assignment of such charter in such form and on such terms as the Lenders may require, and shall deliver to the Agent such other documents equivalent to those referred to at paragraphs 3, 4 and 5 of Part A of Schedule 3 hereof.

The Borrower shall ensure that if the any Owner enters into a time or bareboat charter or a time charter in respect of the its Ship which is of 12 6 or more months in duration, or is capable of exceeding 12 6 months in duration, the such Owner shall, shall at the request of the Agent, execute in favour of the Lenders Security Trustee a first priority assignment of such charter in such form and on such terms as the Lenders may require, and shall deliver to the Agent such other documents equivalent to those referred to at paragraphs 3, 4 and 5 of Part A of Schedule 3 hereof.

The If any Borrower shall ensure that if the Owner enters into a bareboat charter or a time any charter in respect of the its Ship which is of 12 months or more months in duration, or is capable of exceeding 12 months in duration, the Owner shall, at the request of the Agent, duration or into any bareboat charter that Borrower shall execute in favour of the Lenders Lender a first priority assignment Charterparty Assignment in respect of such charter in such form and on such terms as the Lenders may requirethat charter, and shall deliver to the Agent Lender such other documents equivalent to those referred to at paragraphs 3, 4 and 5 of Schedule 5, Part A of Schedule 3 hereofas the Lender may require.
