CHECK SAFEKEEPING. If you can write checks on your account and utilize check safekeeping or any other system offered by us for the retention of your checks, you understand that the canceled checks will be retained by us and destroyed after a reasonable time period or as required by law. If for any reason we cannot provide you with a copy of a check, our liability will be limited to the lesser of the face amount of the check or the actual damages sustained by you. When you request a copy of a check it may be subject to a fee as defined in the Disclosures.

CHECK SAFEKEEPING. Check Safekeeping is automatic on Your Account and Your cancelled checks will not be returned to You. You understand that cancelled checks retained by Us are later destroyed after a reasonable period of time. If You subsequently request a copy of a check and We are unable to supply it, then We shall not be liable for any damage You may sustain in excess of the face amount of the involved check. PERIODIC STATEMENTS. You will be provided with a periodic statement showing activity on Your Account. If You believe any statement reflects discrepancies, You must notify Us of such discrepancies within 60 days from the date We mailed the statement to You. If the discrepancy noted is the result of an electronic fund transfer, then the provisions of Our Electronic Fund Transfer Agreement with You will control resolution of the matter.

YOUR RESPONSIBILITY FOR BACK OF CHECK. All negotiable paper ("checks") presented for deposit must be in a format that can be processed and we may refuse to accept any check that does not meet this requirement. All endorsements on the reverse side of any check deposited into your account must be placed on the left side of the check when looking at it from the front, and the endorsements must be placed so as not to go beyond an area located 1-½ inches from the left edge of the check when looking at it from the front. It is your responsibility to ensure that these requirements are met and you are responsible for any loss incurred by us for failure of an endorsement to meet this requirement. ELECTRONIC CHECKS AND ELECTRONICALLY-CREATED ITEMS. Pursuant to Regulation CC, electronic checks may be treated the same as paper checks for check collection and processing purposes. See the Substitute Checks section for more information. Electronically-created items ("ECI") are check-like items created in electronic form that never existed in paper form. For example, you set up automatic bill payments with us to pay your utility bill. From your account information, we create an ECI that is sent to your utility company for payment. An ECI cannot be used to create a substitute check since it never existed in paper form.
CHECK SAFEKEEPING. Checks and/or check replacement items may not be returned with your statement. Your statement will, however, indicate the number, amount and date of payment of each check or item. Even if you were previously provided with an election as to how checks would be returned to you, we will not be considered in default thereof, so long as images of such checks are made available to you on request. Copies of checks will be available on request for seven (7) years after we receive them (unless applicable law requires that they be kept longer). We may dispose of or destroy all checks that are not returned to you.

CHECK SAFEKEEPING. We will provide you with images of your canceled checks rather than the actual canceled checks. We will retain a copy of your canceled checks, and the originals will not be returned with your account statements. You understand and agree that after we have copied your canceled checks that we may, in our sole discretion and in compliance with Applicable Law, destroy the originals. Our retention of your canceled checks will be done in accordance with Applicable Law. You agree that by maintaining the original (or substitute) check on your behalf that we have made it available to you in a reasonable manner. We will retain copies of your cancelled checks in accordance with Applicable Law. If, for any reason, we cannot return a copy of your cancelled check, you agree that we will not be liable to you for more than the lesser of (a) the face amount of the check we were unable to locate, (b) your Losses, or (c) the amount required by Applicable Law if your request concerns a substitute check. We will not be liable to you for any incidental, special, or consequential damages of any kind.

NOTIFICATION OF NAME OR ADDRESS CHANGE. You will notify Us promptly if You change Your name, move or otherwise have a change of address. When moving to a foreign (non-U.S.) country, whether temporarily or permanently, You are responsible for providing Your citizenship status and proper tax documentation. Change of name or address must be made in writing. In the event We are unable to locate You, You agree to pay all fees associated with maintaining an invalid address in Our records and any costs and locator fees incurred in Our locating efforts.
CHECK SAFEKEEPING. Checking Accounts require “Check Safekeeping.” With Check Safekeeping, we will send or otherwise make available to you (i) Check Images or (ii) information that identifies Checks that have posted to your Account. With Check Safekeeping, your canceled Checks will not be returned to you with your statement, and the front and back of all Checks processed against your Account will be imaged and retained by us for seven (7) years. You agree that the original Check may be destroyed after a reasonable period of time as determined by us. There is no charge for storage of your Check Images; however, you agree to pay the fees associated with receipt of photocopies of any canceled Check images you request, as shown in the Deposit Account Disclosure or the BMO Business Service Fee Schedule. You agree that by maintaining the original Check or a copy on your behalf, we have otherwise made the Check available to you in a reasonable manner. If for any reason we are unable to return a copy of your Check, we may be liable for your Loss but you agree that we will not be liable for more than the face amount of the Check. Some merchants, utilities and other billers may elect to convert your Check into an electronic funds transfer and we will receive electronic information (rather than Checks) for payment from other financial institutions. In such case, you will receive information regarding your transaction on your statement but will not receive your Check or an image of the Check.‌‌‌‌‌‌
