Chronic Violations. If Lessee fails more than twice within any twelve (12) month period to observe or perform any covenant, condition, or agreement of this Lease (including without limitation the payment of rent) after notice from Lessor pursuant to Sections 20(A) or (B), in each case, as the case may be, regardless of whether such defaults shall have been cured by Lessee, the third default shall at the election of the Lessor, in its sole and absolute discretion, be deemed a noncurable Event of Default;
