CIRCUMSTANCES BEYOND OUR CONTROL. Notwithstanding any other provision of these Terms and Conditions, non- performance by us of our obligations under the Agreement shall be excused, without liability for non- performance, during the time and to the extent that such performance is prevented, wholly or partly, by any act of God, fire, earthquake, storm, flood, landslide, strike, lockout, work stoppage or other labour hindrance, explosion or public mains electrical supply failure, sabotage, riot, civil disturbance, national emergency, terrorism, act of war or any other cause beyond our reasonable control.

We shall not be liable to you for failure to deliver any of the Services or for any breach by us of this Agreement, where such failure or breach is due to a reason outside our reasonable control, including, but not limited to, failure of a third party telecommunications provider, lightning, exceptionally severe weather, fire, explosion, war, riots, industrial disputes, acts of terrorism, government action or regulation or national or local emergency; you may terminate the affected Service at any time by notifying us in writing.

CIRCUMSTANCES BEYOND OUR CONTROL. 13.1 If WorldFirst is unable to perform its obligations under this Agreement or an Order or World Account Order because of factors beyond its control or because of a Force Majeure Event, WorldFirst will notify the Client as soon as is reasonably practicable and will use reasonable endeavours to secure the return of any money paid by the Client in respect of which WorldFirst has been unable to discharge its obligations under this Agreement.
CIRCUMSTANCES BEYOND OUR CONTROL. We will make every effort to perform our obligations under these Terms and Conditions. However, we cannot be held responsible for delays or failure to perform if such delay or failure is caused by any circumstances beyond our reasonable control, including, without limitation, an act of God, explosion, flood, fire or accident, war or civil disturbance, strike, industrial action or stoppages of work, any form of government intervention, a third party act or omission, failure of our supplier(s), failure by you to give us a correct delivery address or notify us of any change of address, or a failure by you to affect payment. We will inform you of any such unforeseen event as soon as possible after its occurrence and we will perform our obligations as soon as reasonably possible. Should this interruption continue beyond a period of 30 days you will be entitled to cancel your Order and we will refund the price you have paid, including any delivery charges.
CIRCUMSTANCES BEYOND OUR CONTROL. In this contract "force majeure" shall mean any cause beyond a party's reasonable control (including, by way of example and for the avoidance of doubt, acts of God, war, riot, civil commotion, compliance with any law or governmental order, rule, regulation or direction (including that of a local authority), accident, fire, flood, storm, pandemic or epidemic of any disease, terrorist attack, chemical or biological contamination).

CIRCUMSTANCES BEYOND OUR CONTROL. We will not be liable for any loss or damage that you may suffer because of any abnormal, unforeseeable or unexpected circumstances outside our reasonable control which would have been unavoidable despite all efforts to the contrary, including without limitation, any change, suspension or breakdown of any payment system, any market and/or exchange (whether relating to fiat money or cryptocurrencies); any act of state, government or any financial institution (incl. any regulatory action); any delays or failures caused by problems with any system or network; any breakdown or failure of transmission, communication, data processing or computer facilities; any mechanical breakdown; war, riot or terrorism, any act of God, strikes or similar industrial action; or any prevention from or hindrance in obtaining any real or virtual currencies or any other materials or supplies necessary for the provision of FUMBI Services and/or performance of our obligations under this Agreement.

We shall not be liable to you for any failure to deliver any of the Services or for any breach by us of the Agreement, where such failure or breach is due to a reason outside our reasonable control, for example: failure of a third party telecommunications provider; lightning; exceptionally severe weather; fire; explosion; war; riots; industrial disputes; acts of terrorism; pandemic; government action or regulation or national or local emergency. If such failure to deliver continues for more than three months after the commencement of such failure, then you may terminate the affected Service by giving us notice in writing.
