Common use of City Authority to Move Wires Clause in Contracts

City Authority to Move Wires. City may, at any time, in case of fire, disaster or other emergency, as determined by City in its reasonable discretion, cut or move any other optical fibers, wires, cable, amplifiers, appliances or other parts of the System on, over or under the Right-of-Way of City, in which event City shall not be liable therefor to Company. City shall notify Company in writing prior to, if practicable, but in any event as soon as possible and in no case later than the next business day following any action taken under this Section 5.4.2.

The City shall notify the Company in writing prior to, if practicable, but in any event as soon as possible and in no case later than the next business day following any action taken under this Section 5.4.2.
