City’s Remedies Upon Vendor Default. In the event that Vendor fails to cure any default under this Agreement within the time period specified in this section, City may pursue any remedies available at law or equity, including, without limitation, the following: (1) City shall be entitled to terminate this Agreement without further notice; (2) City shall be entitled to hire another vendor to complete the required work in accordance with the needs of City; (3) City shall be entitled to recover from Vendor all damages, costs, and attorney’s fees arising from Vendor’s default prior to termination, to include the cost of any repair, maintenance, or replacement to City water and wastewater facilities; and (4) City shall be entitled to recovery from Vendor any actual excess costs by: (i) deduction from any unpaid balances owed to Vendor; or (ii) any other remedy as provided by law.
