Common use of CITY'S RESPONSIBILITIES Clause in Contracts

CITY'S RESPONSIBILITIES. 10.1 The Director or a representative appointed by the Director shall act on behalf of City, with respect to the Services to be performed under this Agreement. The Director shall have complete authority to transmit instructions, receive information and interpret and define City’s policies and decisions with respect to materials, equipment, elements and systems pertinent to Consultant’s services. 10.2 City shall give prompt written notice to Consultant whenever City observes or otherwise becomes aware of any defect in Consultant’s Services, in the Work of Construction Contractor or any development which affects the scope or timing of Consultant’s Services. 10.3 City reserves the right to contract directly for the services of the geotechnical engineers, surveyors, material testing and special testing of materials, as required by the code and Contract Documents. In some instances, however, City may request these listed services to be managed by Consultant as an Additional Services. In most instances, Environmental and hazardous waste testing shall be contracted by City.
