Claims Against DISTRICT Sample Clauses

Claims Against DISTRICT. If an injury occurs to any employee of DEVELOPER for which the employee or his/her dependents, in the event of his death, may be entitled to compensation from the DISTRICT, for which compensation is claimed from the DISTRICT, and if such injury is a compensable injury, there will be retained out of the sums due DEVELOPER under this Agreement, an amount sufficient to cover such compensation, until such compensation is paid or it is determined that no compensation is due. If the DISTRICT is required to pay such compensation, the amount so paid will be deducted and retained from any sums due, or to become due to DEVELOPER. If the amount the DISTRICT is required to pay as compensation exceeds the amount due by DISTRICT to DEVELOPER, DEVELOPER shall pay DISTRICT the amount in excess of amounts withheld by the DISTRICT.

If the DISTRICT is required to pay such compensation, the amount so paid will be deducted and retained from any sums due, or to become due to DEVELOPER.
Claims Against DISTRICT. If any injury occurs to any employee of the Contractor or any of the Subcontractors for which the employee or its dependents, in the event of its death, may be entitled to compensation from the District under the provisions of the said Acts, or for which compensation is claimed from the District, there will be retained out of the sums due the Contractor under this Contract, an amount sufficient to cover such compensation as fixed by said Acts, until such compensation is paid or it is determined that no compensation is due. If the District is required to pay such compensation, the amount so paid will be deducted and retained from such sums due, or to become due, the Contractor.
Claims Against DISTRICT. It is understood that the District’s only obligation is to purchase insurance policy and pay such amount as agreed to here-in and no claim shall be made against the District as a result of a denial of insurance benefits by an Insurance carrier.
